United States Patent and Trademark Office Rejects all 18 patent claims by AXON Enterprises, Inc. (AAXN) United States Patent 7,234,262 and PhaZZer Electronics, Inc. files Notice of Appeal from a permanent injunction Order

On August 9, 2017, the United States Patent and Trademark Office (USPTO) Examiner rejected all 18 patent claims by AXON Enterprises, Inc. (formerly known as Taser International, Inc., hereinafter “Taser”) under U.S. Patent No.  7,234,262 (the “’262 Patent”). PhaZZer Electronics, Inc. filed a second ex-parte re-examination of the ‘262 Patent in response to a lawsuit filed by Taser International, Inc. on February 13, 2016 in United States District Court for the Middle District of Florida, alleging, among other things, that PhaZZer Electronics, Inc. infringed Claim 13 of the ‘262 Patent.

The USPTO’s Patent Trial and Appeal Board conducted a comprehensive review of PhaZZer Electronics, Inc.’s arguments and Taser’s ‘262 patent and found Claims 13, 17 and 18 invalid under 35 U.S.C. 103(a) due to prior art.   Further, the USPTO rejected Claims 1-12 and 14-16 as invalid under 35 U.S.C 103(a) due both to prior art and because they “would have been obvious to one of ordinary skill in the art to use a microprocessor that is involved with the firing of a weapon to record in memory the date and time of each actuation of the weapon’s firing trigger.”

PhaZZer Electronics, Inc. has filed a Notice of Appeal to the U.S. Court of Appeals for the Eleventh Circuit on Aug. 10, 2017 in response to the District Court’s July 21, 2017 Order entering a default judgment against PhaZZer Electronics, Inc. and granting Taser International Inc.’s request for a permanent injunction against PhaZZer Electronics Inc.’s CEW products - specifically the PhaZZer Enforcer with a data port – allegedly infringing upon Claim 13 of the ‘262 Patent.

According to Mr. French, “PhaZZer Electronics, Inc. will continue to sell and distribute non-data port CEWs, without time and date stamp, and other accessories in the United States that do not violate the District Court’s Order.”
