Government Dismisses Charges on Business Owner Billy Roberson of Roberson Excavation Inc.

STATEMENT OF ROBERSON EXCAVATION, INC.                                 

Roberson Excavation, a family owned business has been doing business in Florida, Alabama and Mississippi for over thirty years.  We are a community-oriented business and we take great pride in our work.  We have worked tirelessly for decades to not simply build a business, but to build a reputation, and we take that reputation seriously.  The charges against our company were vigorously defended, and in the end, the Government recognized that the charges against our company arose entirely because of the actions of one rogue employee who we fired in early 2015.  The resolution and plea agreement entered with the Government specifically and expressly recognized that the only wrongdoer was this employee.  No member of the Roberson family was determined to have been involved in any manner in the fired employee’s actions and, in fact, were victims of this employee’s wrongful actions.  The Roberson family, as well as the Government, was committed to safe drinking water, and  the water in question was determined to be safe with over 400 tests having been conducted since February of 2015.   We appreciate so much the overwhelming support of our friends and customers.

This resolution proves what we have known all along:  Billy Ray Roberson did nothing wrong in the work his company did for Dale County.  By its actions, the government agrees that a former employee fired by Mr. Roberson is the only person with any criminal liability in this matter.  After only three days of trial, the government dismissed all claims against Billy Roberson, an admission not only that Mr. Roberson had done absolutely nothing wrong, but also that he was completely unaware of the actions of a single, short term, rogue employee who was terminated and who has no involvement whatsoever with Roberson Excavation at this time.

As delighted as we are that Mr. Roberson has been completely cleared of all charges, it never should have come to this.  Mr. Roberson should never have been indicted. The government’s case depended on the representations of a criminal with a long history of trouble with the law including perjury and fraud.  Even more troubling, the government was aware of the history of its “star” witness at the time of its investigation and well before the case was presented to the grand jury.   

By contrast, this is the first time anyone has ever raised any question about Mr. Roberson.  Mr. Roberson is a person of great character and is a living example of the American dream.  He has built a successful family business through hard work and quality performance over many years.  His impeccable reputation is evidence of this. 

We hope this resolution will allow Mr. Roberson and his family to move forward with their lives.
