7 More Complaints by Senior Citizens Filed Against Wyndham Vacation Resorts, Inc., and Joseph Omar Williams Alleging Elderly Exploitation, Deceptive Business Practices and Fraud

Timeshare Cancellation Attorney Susan Budowski has filed seven regulatory complaints on behalf of her clients alleging elderly exploitation, deceptive business practices and fraud against Wyndham Vacation Resorts, Inc., and Wyndham sales agent Joseph Omar Williams in Florida.

Under sworn affidavits, her clients, ages 77 and 80, attest that during a vacation to Daytona in 2018 celebrating their 56th wedding anniversary, they attended an owners informational meeting. Living on a fixed income, her clients expressed their concerns about their ownership and financial instability to maintain their membership, due to advancing in age and increasing health issues. They in fact communicated to their sales agent Joseph Omar Williams, that they wanted to reduce their ownership to a smaller unit and have smaller monthly payments. 

Their sales agent Joseph Omar Williams expressed compassion for her clients’ medical and financial issues and told them he would “treat them as if they were his own parents.”  He told her clients he would lower their payment, and that they apparently had 2 contracts, and that by consolidating them, they would save money. 

After a lot of discussion, Mr. Williams disappeared for quite some time and upon his return he told her clients that he found a $24,000 error in their 2017 upgrade. He stated they would receive credit for this – and then left yet again, for an hour, to find “additional errors that would be financially beneficial.” 

When Mr. Williams left to prepare their paperwork for the consolidation, he advised her clients “not to speak to anyone regarding the ‘financial error’ he found, because he was taking care of it.” 

Her clients were with Mr. Williams waiting to sign their new documents when a woman came into the room holding a large stack of papers. Mr. Williams stated to the woman, “I’ll do this, you don’t need to. You don’t have to stay.” The woman put down the stack of papers in front of Mr. Williams and left the room. 

Her clients signed a mortgage deed in front of Mr. Williams and nobody else – he was both the sales agent and closing representative. They wrote down their reasons for the purchase which was to “consolidate” and “no more PIC.”  A Florida Notary stamped and signed the mortgage deed – although her clients had never even met with this notary.

Weeks after the purchase, her clients received a Wyndham statement in the mail. Their monthly payments doubled from $528.13 a month to $1,073.75 a month. They filed a complaint with Wyndham Owner Care – and after waiting for an answer for 5 months, they were told there was nothing Wyndham could do. Her clients never actually had 2 contracts to consolidate – Wyndham sales agent Joseph Omar Williams, knowingly and willfully conveyed fraudulent information as material facts to consummate a commission for his own benefit. 

As of the time of this release Wyndham, having been in receipt of this transaction information since June 25, 2019, has chosen to ignore this serious matter.

“I find the lack of urgency and concern demonstrated by Wyndham on a matter as egregious as alleged elderly exploitation by one of their sales agents to be deeply troubling”, Budowski said. 

Attorney Budowski also states, “I believe this is a matter that warrants a thorough investigation by the Attorney General to not only resolve this matter, to send a message loud and clear this type of predatory targeting of our seniors will not be tolerated.” 

Her clients seek contract cancellation, a refund and a full release from any Wyndham ownership. “My clients feel such a betrayal of trust and good faith they want no further association with Wyndham, I personally understand.”
