Percentage of Claims Alleging Retaliation Reaches Record High

The EEOC recently released the Enforcement and Litigation Data for Fiscal Year 2014, which ran from Oct. 1, 2013, to Sept. 30, 2014.  According to the data tables, for the private sector, there were 88,778 charges of workplace discrimination received by the agency. 

The EEOC found that the percentage of claims alleging retaliation has reached a record high with 37,955 retaliation charges under all statutes, which made up 42.8 percent of all charges filed with the EEOC in 2014.

 “Record highs are nice to find when you’re sunning yourself next to a sparkling blue pool, but when it has to do with retaliation claims, that’s not something that, as the owner of a company, I take lightly”, said Lisa Garrett, Chief Executive Officer of Vero Integritas Global, Inc.

According to the EEOC, monetary relief from cases litigated, including settlements, totaled $22.5 million in 2014.

Originally called, the “Positive Employee Expectations Program”, the ERS system evolved into a one-of-a-kind software program developed by Garrett to help clients navigate the treacherous legal landscapes associated with employee relations.

“The ERS design is based upon the needs of owners and CEOs of companies, and from my own experiences as an Employee Relations Consultant working on overseas contracts. I’ve seen firsthand how costly it can be to a company to ignore employee complaints and concerns. We live in an age where nothing can be swept under the carpet. At any given time, an employee lawsuit can hit an employer right between the eyes", Garrett continued. "The purpose of this system is to minimize the liability and costs associated with these types of issues. A company should not have to pay out large sums of their hard earned dollars simply because they were so busy managing their business that they failed to properly manage their employees”, she said.

 The ERS system is designed to change the way employers handle the administrative burden of employee relations issues. “It puts the information directly in the employer’s path to help them make the right decisions and avoid issues like negligent hiring or sexual harassment and discrimination claims”, stated Garrett. “I can’t count how many times an employer I consulted for needed to make a decision about a poor performer and had no documentation to support a negative employment decision", she said.

ERS began its initial Beta testing phase on July 1, 2016, which is scheduled to end this November. “Right now we’re offering reduced pricing for clients who come in early and use just the system template”, said Garrett.

"We are preparing the unveiling of the full-blown system at the New York Business Expo on November 10, 2016. It's the beginning of a new dawn in the world of Human Resources”, Garrett stated.
